2. Services et tarifs

Taipan Transit propose notamment :

• des tunnels GRE, IPsec et WireGuard ;
• des adresses IPv4 routées, à partir de 0,70 € par adresse et par mois ;
• du transit avec protection anti-DDoS incluse (jusqu'à 7 Tb/s, couverture L3/L4/L7, trafic sous mitigation non décompté) et filtrage Netbait optionnel et gratuit ;
• des services additionnels affichés dans le Panel (bande passante additionnelle, adresses IP supplémentaires, options de configuration).

Les prix sont exprimés en euros, affichés dans le Panel au moment de la commande, et n'incluent pas de TVA (TVA non applicable, article 293 B du CGI). Des remises temporaires (campagnes) ou des coupons peuvent s'appliquer et sont détaillés dans le récapitulatif de commande avant paiement. Taipan Transit peut faire évoluer ses tarifs ; toute évolution est communiquée avec un préavis raisonnable et ne s'applique pas rétroactivement aux abonnements déjà en cours pendant la période payée.

3. Processus de commande

La commande s'effectue depuis le Panel : sélection du Service, consultation du récapitulatif (composition du prix, remises éventuelles), acceptation des cases de confirmation obligatoires (usage acceptable, acceptation des CGU et des CGV), puis paiement. La commande est réputée définitive à réception de la confirmation de paiement. Une confirmation est envoyée par email.

4. Paiement et facturation

Les paiements sont traités par Stripe, prestataire de paiement tiers. Taipan Transit ne stocke jamais les données de carte bancaire du Client ; celles-ci sont gérées exclusivement par Stripe conformément à ses propres conditions et à la norme PCI-DSS.

Les Services souscrits font l'objet d'une facturation récurrente (abonnement) prélevée automatiquement à échéance sur le moyen de paiement enregistré, sauf résiliation effectuée avant la date de renouvellement conformément à l'article 6. En cas d'échec de paiement, Taipan Transit peut relancer le prélèvement, notifier le Client, puis suspendre voire mettre en blackhole les ressources concernées si la situation n'est pas régularisée dans un délai raisonnable.

5. Durée et reconduction

Sauf indication contraire au moment de la commande, les Services sont souscrits pour une durée d'un mois, reconduite tacitement par périodes successives identiques à chaque échéance, jusqu'à résiliation par le Client.

6. Résiliation par le Client

Le Client peut résilier un Service à tout moment depuis le Panel ou en écrivant à [email protected]. La résiliation stoppe la reconduction du Service à l'échéance de la période en cours : le Service reste actif jusqu'à la fin de la période déjà payée, sans remboursement au prorata de la période entamée, quelle que soit la date de la demande de résiliation au cours de cette période.

7. Renonciation au droit de rétractation

Les Services souscrits par un Client ayant la qualité de consommateur sont mis en œuvre immédiatement après confirmation du paiement (provisionnement du tunnel et/ou des adresses IP). En cochant la case dédiée lors de la commande, le Client demande expressément l'exécution immédiate du Service et reconnaît, conformément à l'article L. 221-28, 13° du Code de la consommation, renoncer à son droit de rétractation de 14 jours dès lors que l'exécution du Service a commencé avec son accord préalable exprès.

8. Engagements techniques

Sauf mention contraire dans une offre spécifique, Taipan Transit met en œuvre les moyens suivants, à titre d'engagement de moyens et non de garantie de résultat : bande passante garantie de 200 Mbit/s avec capacité disponible jusqu'à 1 Gbit/s selon l'offre souscrite, latence moyenne de l'ordre de 15 ms, protection anti-DDoS incluse jusqu'à 7 Tb/s couvrant les attaques L3/L4 et L7 sans facturation additionnelle ni décompte du trafic sous mitigation. Ces indications ne constituent pas une garantie de disponibilité continue à 100 % et n'ouvrent pas droit à pénalité contractuelle en l'absence d'accord de niveau de service (SLA) spécifique signé entre les parties.

9. Usage acceptable et suspension

L'usage des Services est soumis aux règles définies à l'article 6 des CGU et à la politique d'usage acceptable. Tout manquement peut entraîner la mise en blackhole de l'adresse IP concernée jusqu'à résolution de l'incident, voire la suspension ou la résiliation du Service, sans remboursement, conformément aux CGU et à l'article 6 des présentes CGV.

10. Responsabilité et garanties

Le Client demeure seul responsable du contenu, des services et du trafic transitant par les ressources qui lui sont assignées, ainsi que de leur conformité à la réglementation applicable. La responsabilité de Taipan Transit, en cas de manquement avéré à ses obligations, est limitée aux sommes effectivement versées par le Client au titre du Service concerné au cours des douze derniers mois, et exclut tout dommage indirect (perte de chiffre d'affaires, perte de données, préjudice d'image).

11. Réclamations et support

Toute réclamation relative à une commande peut être adressée via le système de tickets du Panel ou à [email protected].

12. Modification des CGV

Taipan Transit peut modifier les présentes CGV. Les modifications tarifaires ou substantielles sont notifiées avec un préavis raisonnable et ne s'appliquent qu'aux commandes et renouvellements postérieurs à leur entrée en vigueur, sauf disposition légale contraire.

13. Droit applicable et juridiction

Les présentes CGV sont soumises au droit français. Tout litige relève, à défaut de résolution amiable, des tribunaux français compétents, sans préjudice du droit pour le Client consommateur de recourir à la médiation de la consommation décrite dans les mentions légales.

2. Services and pricing

Taipan Transit offers, among others:

• GRE, IPsec and WireGuard tunnels;
• routed IPv4 addresses, starting at €0.70 per address per month;
• transit with included DDoS protection (up to 7 Tb/s, L3/L4/L7 coverage, traffic under mitigation not counted) and optional, free Netbait filtering;
• additional services shown in the Panel (extra bandwidth, additional IP addresses, configuration options).

Prices are shown in euros in the Panel at the time of ordering and do not include VAT (VAT not applicable, Article 293 B of the French Tax Code). Temporary discounts (campaigns) or coupons may apply and are itemized in the order summary before payment. Taipan Transit may change its prices; any change is communicated with reasonable notice and does not apply retroactively to subscriptions already active during a paid period.

3. Ordering process

Orders are placed from the Panel: selecting the Service, reviewing the summary (price breakdown, applicable discounts), accepting the mandatory confirmation checkboxes (acceptable use, acceptance of the ToS and ToSale), then payment. The order is deemed final upon receipt of payment confirmation. A confirmation is sent by email.

4. Payment and billing

Payments are processed by Stripe, a third-party payment provider. Taipan Transit never stores the Customer's card details; these are handled exclusively by Stripe in accordance with its own terms and the PCI-DSS standard.

Subscribed Services are billed on a recurring basis and automatically charged at each renewal to the saved payment method, unless cancelled before the renewal date in accordance with Article 6. In the event of a failed payment, Taipan Transit may retry the charge, notify the Customer, then suspend or blackhole the affected resources if the situation is not resolved within a reasonable time.

5. Term and renewal

Unless stated otherwise at the time of order, Services are subscribed for a one-month term, automatically renewed for successive identical periods at each renewal date until cancelled by the Customer.

6. Cancellation by the Customer

The Customer may cancel a Service at any time from the Panel or by writing to [email protected]. Cancellation stops renewal at the end of the current period: the Service remains active until the end of the already-paid period, with no pro-rata refund for the period underway, regardless of when the cancellation request is made during that period.

7. Waiver of the right of withdrawal

Services subscribed by a Customer qualifying as a consumer are provisioned immediately upon payment confirmation (tunnel and/or IP address activation). By checking the dedicated box at checkout, the Customer expressly requests immediate performance of the Service and acknowledges, in accordance with Article L. 221-28, 13° of the French Consumer Code, waiving their 14-day right of withdrawal once performance of the Service has begun with their prior express consent.

8. Technical commitments

Unless stated otherwise in a specific offer, Taipan Transit uses the following as a best-efforts commitment rather than a guaranteed outcome: guaranteed 200 Mbit/s bandwidth with capacity available up to 1 Gbit/s depending on the plan, average latency around 15 ms, included DDoS protection up to 7 Tb/s covering L3/L4 and L7 attacks at no additional charge and without counting mitigated traffic. These figures do not constitute a guarantee of 100% continuous availability and do not entitle the Customer to contractual penalties absent a specific signed service level agreement (SLA).

9. Acceptable use and suspension

Use of the Services is subject to the rules set out in Article 6 of the ToS and the acceptable use policy. Any breach may result in the affected IP address being blackholed until the incident is resolved, or in suspension or termination of the Service, without refund, in accordance with the ToS and Article 6 of these ToSale.

10. Liability and warranties

The Customer remains solely responsible for the content, services and traffic passing through the resources assigned to them, and for their compliance with applicable regulations. Taipan Transit's liability, in the event of a proven breach of its obligations, is limited to amounts actually paid by the Customer for the relevant Service over the preceding twelve months, and excludes any indirect damages (loss of revenue, data loss, reputational harm).

11. Complaints and support

Any complaint about an order can be submitted through the Panel's ticketing system or to [email protected].

12. Changes to the ToSale

Taipan Transit may amend these ToSale. Pricing or material changes are notified with reasonable notice and only apply to orders and renewals placed after they take effect, unless otherwise required by law.

13. Governing law and jurisdiction

These ToSale are governed by French law. Absent an amicable resolution, disputes fall under the jurisdiction of the competent French courts, without prejudice to the consumer Customer's right to use consumer mediation as described in the legal notice.
